. pp 463-64, "In 1699 Thomas Godwin was sworn in as a Burgess and quietly took his seat in the House. But no for long. His opponent, Thomas Milner, contested the election successfully and won the seat. This case it seems created quite a stir at the time and gives an interesting sidelight on the conducting of elections in early days. Mr. Milner asked for a polled vote. The Sheriff, Thomas Jordan, had used the method much in vogue in the Colony and declared the election by the size of the crowds in favor of the nominees. Godwin's he declared to be the largest party, Milner's petition being granted Godwin declared himself ready for the fray, thought the house offered to extend the time given him for the new election. When the poll was takien Milner won by one vote. In England a law had been passed requiring the poll; but in the colonies it was becoming a matter of custom to take a poll but had not become a law.
