Notes for John English

Source: Georgia's Landmarks, Memorials and Legends, Lucian Lamar Knight, The Byrd Printing Company, p 387: Governor Wright held a meeting of loyal citizens in Savannah, soon after the famous meeting of the patriots on August 10, 1774. The purpose of the meeting was to check the growing sentiment of hostility to the Crown. Among those who attended were quite a number of conservatives, who were not prepared for radical action at this time but were later found on the side of the Colonies. Resolutions of Protest were adopted by Friends of the King among those listed was a John English. Could he be the father of John born 1775?

Under English common law, which was followed in America, a male became an adult at age 21. Taxes are assessed on lands and have to be paid regardless of the age of the owner. There are no age limits on who can own land.

Georgia Tax Act of 1801, pulled from the Georgia Legislative Documents Project. It is typical of the poll taxes which were enacted annually.
SEC 2. "And be it further enacted, that the sum of thirty one and a quarter cents, shall be levied on all free male white persons of the age of twenty one years and upwards in this state; and the sum of thirty one and a quarter cents on all negroes and other slaves under sixty years, within the limits of the same; and the sum of thirty one and a quarter cents on every hundred dollars value of every lot, whars, or other lands not herein already enumerated; and on all other buildings within the limits of any Town, Village, or Borough, within the same; the sum of thirty one and a quarter cents upon all male free negroes, mulattoes and mustizoes, from the age of twenty one years and upwards, over and above the taxable property they may be [Illegible Text] of, and the sum of thirty one and a quarter cents shall be levied on every hundred dollars value of all persons stock in trade, shop-keepers and others, to be computed at prime costs, and the return to be made on oath, that the stock in trade so returned is the highest estimation of the stock in such persons possession, at any time not exceeding three months preceding the time appointed by this law for such stock in trade to be estimated and returned; ..."

John English bought 62 acres from John Dunaway, 12 Dec 1798

This Indenture made this twelfth day of December in the year of our Lord one thousand seven hundred ninety eight, between John Dunaway of the County of Warren and State above written, of the one part, and John English of the said State and County of the other part. Witnesseth, that for and in consideration of the sum of one hundred and fifty dollars in hand well and truly paid unto the said Dunaway, by the said John English at or before the sealing and delivery of these presents, the receipt whereof is hereby acknowledged, hath granted, bargained, sold and confirmed, by these presents, a certain tract or parcel of land of about sixty two acres, be the same more or less, lieing in the said State and County and lies on the west side of the Long Branch of Briar Creek, and is part of a four hundred acre tract granted to said Dunaway the thirteenth day of October, one thousand seven hundred and eighty five, and is bounded by North and West lines of said four hundred acre tract, and is to begin at the Mouth of a Branch, on the North side of said Dunaway's Old Field at a stake and run South Westwardly to a black oak X. thence North Eastwardly to a pine, bounded by Draper's land, then South Eastwardly to a stake at said Long Branch, bounded by Dick's land, thence down the said Long Branch, to the beginning stake corner, together with all the rights, titles, claims, interests, claims, or demands in, to, or out of the same, to have and to hold the said Land and premises aforesaid, unto the only use benefit and behoof, of him the said John English his heirs and assigns, and the said John Dunaway and his heirs, the said Tract of land and premises, will warrant and forever defend unto the said John English, his heirs and assigns against him, the said John Dunaway, his heirs and assigns, and every other person or persons whatsoever. In witness whereof he, the said John Dunaway, has hereunto set his hand and seal, the day and year first above written.

This Indenture made this fourth day of June in the year of our Lord one thousand eight hundred and three between John Dunaway and Jonathan Dunaway of the State of Georgia and Warren County of the one part and John English of the same State and County of the other part. Witnesseth that the said John and Jonathan for and in consideration of the sum of one hundred and fifty dollars to him in hand well and truly paid by the said John English, at or before the sealing and delivery of these presents, the receipt whereof is truly acknowledged, hath given granted, bargained, sold, delivered, and confirmed, and by these presents doth give, grant, bargain, sell, deliver and confirm to said John English his heirs and assigns all that tract or parcel of land, containing fifty acres by the same more or less, situated lieing and being in Warren County and State aforesaid on the waters of Brier Creek, beginning at a post oak corner by J. Carter's land on Eastward, Dunaways, line running S 16 E. to the Long Branch to a stake, from thence up said Branch to a stake joining said Englishs land from thence South Westwardly to post corner on said English line from thence a Direct Course along Dunaways line to the beginning oak corner, said being part of a four hundred acre tract originally granted to John Dunaway the thirteenth day of October 1785 together with all and singular, the rights members and appurtenances thereunto belonging or in any wise appertaining and also all the estate, rights, title, interest, claims, or demand in to or of the same to have and to hold the said land and premises aforesaid unto the only use benefit and behoof of him the said John English his heirs and assigns and the said John Dunaway and Jonathan Dunaway for themselves their heirs and do by these presents warrant and defend the said land and premises against themselves their heirs or any other person or persons whatsoever claiming or to claim fee simple. This Indenture made this eleventh day of February in the year of Our Lord one thousand eight hundred and eight, between Nancy Burson Administratrix and Isaac Burson Administrator on the Estate of Jonathan Burson Dec'd of Warren County, of the one part, and John English of the State aforesaid and same County, of the other part. Witnesseth, that the said Nancy and Isaac Burson, for and in consideration of the sum of one hundred and twenty six dollars, to them in hand well and truly paid by said John English, at or before the sealing and delivering of these presents, the receipt whereof is hereby acknowledged, hath granted, bargained and sold, unto the said John English, his heirs and assigns, all that tract or parcel of land containing one hundred acres, more or less, situate, lying and be in the State and County aforesaid, on the waters of Brier Creek, being one half of a two hundred acre tract, originally granted to Moses Hill, 14th October 1788. Beginning at a W. oak corner (one of the original corners), then running N. 30 W. with the original line twenty chains to a stake, then due west across the original tract until it comes to the original line, then south 10 E. with the original to stake, then with the original to the beginning, reference had to the plat for courses and distances, joining Duckworth, Williams, and Shows, together with all and singular the rights members and appurtenances to the said land and premises, for the only use benefit and behoof of him the said John English, his heirs and assigns, said Nancy and Isaac warranting and defending the same, against themselves or any other person claiming or to claim. Witnesseth, that for and in consideration of the sum of two hundred dollars in hand will and truly paid unto the said John English, by the said John Wilson at or before the Sealing and delivery of these presents, the receipt whereof is hereby acknowledged, hath granted, bargained, sold and confirmed by these presents, a certain tract or parcel of Land, of about fifty acres, be the same more or less. Situate lying and being in Warren County, and state aforesaid, on the waters of Brier Creek, beginning at a post and corner, by J. Carter's Land, on Daniel Shows's line running South 7, E. to the long branch to a stake, from thence up Branch to a stake joining English's Land, from thence South Westwardly to a post oak corner on said English's line, from thence along Daniel Shows's line to the beginning post oak corner, it being a part of a four hundred acre tract granted to John Dunaway the thirteenth day of October 1785. Together with all and singular the rights, member appurtenances thereunto belonging, or in any wise appertaining, and also all the right, title, interest, claim or demands into or out of the same, to have and to hold, the said land and premises aforesaid, unto the only use, benefit and behoof of him the said John Wilson his heirs and assigns, and the said John English for himself, his heirs, do by these presents warrant and defend said Land and premises, against himself, his heirs or any other person or persons whatsoever claiming or to claim in fee simple. Actual newspaper found in Georgia Archives microfilm drawer 185 box 58, The Southern Recorder, Milledgeville, Georgia, April 23, 1839, p 3, No. 14, Vol XX, The writer describes him as "frank, generous and forgiving...his home was the seat of hospitality"

Jones Co, GA court records: at the same time that Green English and Jonathan English were granted letters of administration for John English's estate, the court took up the matter of Green English, as the nearest kin of John English deceased who was the administrator of Joseph Duckworth's estate and intermarried with his widow Ann, and James Smith, representing the Legatees of said Duckworth, to determine who would be granted letters of administration. The court ruled for James Smith who had to put up $25,000 security.

July 1, 1839 Inventory of John English's estate, Jones County, GA, Court of Ordinary including his property. Listed amount the notes held by the deceased were 4 notes signed his son-in-law Lewis Griffith (Eliza's husband) for over $1,300.

Jones Co, GA Court of Ordinary 1837-1854, p 279, Green and Jonathan English have fully administered the estate and ask the court to dismiss them, the court ruled to publish for 6 months according to law and if no one brought cause then they would be dismissed.

Buried in the English Family Cemetery located Dist 11 Land Lot 47, GPS 33.03403 North by -83.60121 West. From the railroad intersection in Gray, GA, travel US Hwy 129 south one mile to the Greensettlement Rd. Turn right and travel approx. 3.5 miles to Dye Road and turn left. Travel approx. 0.6 mile to the Dye resident located on the right of the road. From the road the cemetery is located to the left and rear of the house. It can be seen from the road as two huge trees surrounded by piles of built up rocks. The piling of the rocks is similar to those found in the rock fence surrounding the Green English cemetery. Possibly the same English family member made both.
